1. Agreement to terms
These Terms of Service (“Terms”) govern your access to and use of the ThinkQuest website and online learning platform (the “Service”). By creating an account or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you may not access or use the Service.
2. Definitions
- “Service” means the ThinkQuest website, applications, content, and related features.
- “User”, “you” means any person who accesses or uses the Service.
- “Content” means courses, study materials, quizzes, text, graphics, and other materials made available through the Service.
- “User Content” means anything you submit, such as comments, messages, or a profile photo.
3. Eligibility and accounts
To use the Service you must be capable of forming a legally binding contract. By registering, you confirm that the information you provide is accurate and complete, and you agree to keep it up to date.
- New accounts may require administrator approval before access is granted.
- You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
- You must not share your account, create multiple accounts to gain an unfair advantage, or impersonate any person or entity.
- Notify us immediately if you suspect any unauthorised use of your account.
4. Acceptable use
When using the Service, you agree not to:
- use the Service for any unlawful purpose or in violation of these Terms;
- attempt to gain unauthorised access to any part of the Service, other accounts, or our systems;
- interfere with or disrupt the integrity or performance of the Service;
- introduce viruses, malware, or any other harmful code;
- scrape, harvest, or copy Content in bulk without our prior permission;
- post content that is unlawful, defamatory, harassing, hateful, infringing, or otherwise objectionable; or
- misrepresent your identity or affiliation with any person or entity.
5. Quizzes, scoring and academic integrity
Quizzes on the Service are timed and may be proctored. To keep things fair for everyone, the Service may record certain activity during a quiz — for example, switching browser tabs, exiting fullscreen, minimising the window, or attempting to copy text. By taking a quiz, you acknowledge and consent to these anti-cheating measures.
Attempts that involve cheating, automation, or any circumvention of the quiz system may be voided. Repeated or serious violations may result in suspension or termination of your account. Scores and leaderboard rankings are provided for educational and motivational purposes and may be recalculated or removed if we detect irregularities.
6. Intellectual property
The Service and all Content (excluding User Content) are owned by ThinkQuest or its licensors and are protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Content for your personal, non-commercial, educational use.
You may not reproduce, distribute, modify, publicly display, resell, or create derivative works from the Content without our prior written permission.
7. User content
You retain ownership of your User Content. By submitting User Content, you grant ThinkQuest a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service.
You are responsible for your User Content and represent that you have the necessary rights to submit it and that it does not violate these Terms or any law. We may remove User Content that we believe violates these Terms or is otherwise objectionable, at our discretion.
8. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect and handle your information. Please review it carefully.
9. Free service and availability
The Service is currently provided free of charge. We may add, modify, suspend, or discontinue any part of the Service at any time. We do not guarantee that the Service will be available, uninterrupted, timely, secure, or error-free, and we may impose limits on certain features or restrict access without notice.
10. Disclaimer of warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Content is accurate, complete, or current, or that using the Service will achieve any particular result.
11. Limitation of liability
To the maximum extent permitted by law, ThinkQuest and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or in connection with your use of (or inability to use) the Service. Our total liability for any claim relating to the Service shall not exceed the amount you paid us to use it — which, for a free service, is zero.
12. Indemnification
You agree to indemnify and hold harmless ThinkQuest and its operators from any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or any applicable law.
13. Suspension and termination
We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we discontinue the Service. You may stop using the Service and delete your account at any time from your account settings. Provisions that by their nature should survive termination — such as intellectual property, disclaimers, limitation of liability, and indemnification — will continue to apply.
14. Third-party services
The Service may integrate with or link to third-party services (for example, third-party sign-in or email delivery). Your use of those services is governed by their own terms and policies, and we are not responsible for them.
15. Governing law
These Terms are governed by the laws applicable in the operator's principal place of business, without regard to conflict-of-laws principles. You agree to submit to the jurisdiction of the competent courts located there for the resolution of any dispute arising out of or relating to these Terms or the Service.
16. Changes to these terms
We may revise these Terms from time to time. When we make material changes, we will update the “Last updated” date at the top of this page. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms.
17. General
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right. These Terms, together with our Privacy Policy, constitute the entire agreement between you and ThinkQuest regarding the Service.
